Successful gas injunction obtained despite Coronavirus

Halton Housing has been granted an injunction to gain access to a property in Widnes to carry out important gas safety checks.

Gas regulations mean Halton Housing has to check all homes once a year.

An injunction is a Court order which orders a company or person to do (a “mandatory injunction”) a particular act or thing. A party who breaches an injunction can be held in contempt of Court which in some circumstances can lead to imprisonment.

Multiple attempts were made to contact the customer to allow access to carry out the check, including letters, phone calls, text messages and personal visits from engineers.

The injunction, which costs the customer £320.00 comes as increasing numbers of customers are refusing gas engineers access to their homes because of Coronavirus fears.

Despite the ongoing crisis, housing providers like Halton Housing still have a legal requirement to complete essential safety checks such as gas servicing.

The injunction will allow gas engineers to gain access to the property. Further court proceedings and costs of £850.000 can be incurred if they are not complied with and the possibility of the customer losing their home in future.

Jon Blackwell, Head of Repairs & Maintenance said: “We know this is a worrying time but keeping customers safe is our top priority. In this lockdown period, we’re all spending more time at home so it’s essential that gas appliances are working safely and customers are not at risk.”

“We have a legal obligation to carry out gas safety checks and this has not changed due to Coronavirus. We would encourage all customers to allow us access to their homes to carry out this vital check. Courts are still operating and failure to comply could result in proceedings to gain access.”

Halton Housing gas engineers are all following safe systems of work protocols and will wear appropriate personal protective equipment and will aim to complete the check as quickly as possible. Customers don’t even need to be in the same room. Engineers will also ensure customers’ home are left clean and tidy, including sanitising any surfaces touched.

Customers who have a gas safety check scheduled, in addition to appointment letters will also receive follow up phone calls and/or texts prior to an engineer arriving to check that it’s safe for us to come out, and that you’re happy for us to proceed.
